Tribal Elections: Ordinances and Procedures

This workshop will help to clarify how tribal elections are a primary assertion of self-governance and self-determination.

Problems resulting from the conduct of tribal elections are likely more numerous than any other single issue in the exercise of Indian self-government. Election disputes too often bring the entire operation of a tribe to a halt while both sides debate the issue and attempt to involve some outside governmental entity (e.g., the Bureau of Indian Affairs in the U.S.) to resolve the dilemma. Improperly conducted elections unfortunately send a reasurring message to critics of tribal governments: there are tribes that routinely place new officials in office, or decide on issues, with little or no questions raised about the fairness of the elections. This workshop will aid your tribe in developing sound election laws and procedures that will project an image of stability and promote both internal and external respect.

The session will help to explain how a smooth transition of power is aided by certain provisions in the Tribal Constitution, including an objective Election Board, an adequate set of procedures, and an effective platform for the resolution of election disputes.
